Article 1: Description of Service & Referral Platform

1.1 Marketing & Referral Hub: Johnstown Plumbing Co is a digital marketing, consumer resource, and telephone routing directory that facilitates connections between homeowners, commercial property managers, and independent plumbing trade contractors serving Greater Johnstown and Cambria County, Pennsylvania.

1.2 Not a Plumbing Contractor: Johnstown Plumbing Co is NOT a licensed plumbing contractor, does not provide plumbing repair or installation services directly, does not employ licensed master or journeyman plumbers, and is not a party to any contract, agreement, or transaction between property owners and independent contractors.

1.3 Free Referral Service: Access to this website and telephonic routing via (814) 546-1121 is provided free of charge to consumers. We may receive referral compensation or advertising fees from participating independent contractors for inbound service routing.

Article 2: Independent Contractor Disclaimer & No Warranty

2.1 Independent Third Parties: All trade professionals, technicians, and plumbing companies connected through this service operate as completely independent business entities. They are not partners, joint venturers, agents, or employees of Johnstown Plumbing Co.

2.2 Disclaimer of Warranties: To the fullest extent permitted under applicable law, Johnstown Plumbing Co makes NO representations or warranties whatsoever—express, implied, statutory, or otherwise—regarding the qualifications, skill, timeliness, price, safety, or quality of workmanship or materials provided by any independent contractor.

2.3 Direct Contractual Relationship: Any contract, estimate, warranty, or guarantee for plumbing labor, parts, fixtures, or repairs is entered into solely and exclusively between the homeowner and the dispatched independent contractor. Johnstown Plumbing Co assumes no responsibility or liability for performance or breach of such agreements.

Article 3: Homeowner Due Diligence & Verification Duty

3.1 Verification Obligation: It is the sole and absolute responsibility of the property owner to inspect and confirm all credentials of any contractor dispatched to the premises before authorizing work or executing financial transactions. This includes verifying:

  Trade Licensure: Active Pennsylvania Home Improvement Contractor (PA HIC) registration and any municipal master plumbing licenses required in Cambria County.

  Insurance Coverage: Current Certificates of Commercial General Liability and Worker’s Compensation insurance.

  Permitting: Acquisition of all necessary municipal plumbing, excavation, or sewer connection permits from local township or city code enforcement authorities.

3.2 Actor & Model Depictions: All individuals depicted in photographs, graphics, or video media on this website are actors or models and are not contractors or technicians listed on this site.

Article 4: On-Site Estimates & Pricing Independence

4.1 No Price Fixing or Blind Estimates: Johnstown Plumbing Co does not set, monitor, control, or guarantee prices, diagnostic trip fees, labor rates, or emergency surcharges charged by independent contractors.

4.2 Upfront Written Estimates: Dispatched local technicians evaluate the issue on-site and provide an itemized upfront written estimate before any work begins. Homeowners have full discretion to accept or decline any written estimate presented by an independent contractor.

4.3 Direct Billing: All financial transactions, invoices, diagnostics fees, and payments are settled directly between the consumer and the performing contractor. Johnstown Plumbing Co does not collect fees for trade labor or materials.

Article 5: Comprehensive Limitation of Liability

5.1 Exclusion of Damages: Under no circumstances shall Johnstown Plumbing Co, its operator Waseem Arif, officers, affiliates, agents, or licensors be held liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

  Water intrusion, mold or mildew proliferation, structural rot, or flooring destruction.

  Subsurface sewer line collapse, foundation slab settlement, or street excavation liabilities.

  Contractor negligence, delay, property damage, personal injury, or contractual disputes.

  Loss of utility service, temporary property relocation costs, or business interruption.

5.2 Total Liability Cap: In jurisdictions where limitations of liability are restricted, our total cumulative liability to you for any and all claims shall not exceed the amount of fifty U.S. dollars ($50.00).

Article 6: Dispute Resolution, Mandatory Arbitration & Governing Law

6.1 Governing Law: These Terms and any claim or dispute arising from the use of this Site or referral routing shall be governed by and construed in accordance with the substantive laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

6.2 Mandatory Individual Arbitration: You agree that any legal dispute, controversy, or claim arising out of or relating to these Terms or our referral service shall be resolved by binding individual arbitration administered in Cambria County, Pennsylvania under the Commercial Arbitration Rules of the American Arbitration Association (AAA).

6.3 Class Action Waiver: You agree to resolve any dispute solely on an individual basis and explicitly waive any right to bring or participate in a class action, collective proceeding, or representative lawsuit against Johnstown Plumbing Co or its operator.
